Terms and Conditions of the 1xBet Viber Bot Competition

Participation in the 1xBet Viber Bot Competition (hereinafter the "Competition") is subject to these Terms and Conditions (hereinafter the "Terms"). By taking part in the Competition, the user agrees to be bound by these Terms, and should therefore read them carefully. If the user does not agree to be bound by these Terms, they should not take part in the competition.

The "Organizer" refers to Black Mustand One LTD (a company incorporated in the Seychelles with offices at Global Gateway 8, Rue de la Perle, Providence, Mahe, Seychelles) and its affiliates and subcontractors. The “Technical Provider”, which provides the platform for the Competition, refers to Viber Media S.à r.l., a company incorporated in the Grand Duchy of Luxembourg with offices at 2 Rue du Fossé, L-1536 Luxembourg, referred to hereinafter as “Viber”.

Participants

In order to participate in the Competition, the user must be from one of the following countries: Australia, Russia, Ireland, Norway, Finland, Singapore, Switzerland, Canada, Belgium, New Zealand, Netherlands, Japan, Austria, Israel, Hong Kong, Thailand, Hungary, Kuwait, Turkey, United Arab Emirates, Taiwan, Greece, Iraq, Slovenia, Malaysia, Romania, Ukraine, Serbia, Algeria, Belarus, Bosnia and Herzegovina, Sri Lanka, Bulgaria, Myanmar, Egypt, Croatia, Vietnam, Philippines, South Korea, Qatar, Luxembourg, Kazakhstan, Indonesia, Cambodia, Lithuania, Latvia, Albania, Georgia, Macedonia, Montenegro, Armenia, Tunisia, Nepal, Bangladesh, Moldova, Libya, Estonia, India, Lebanon, Maldives, Tajikistan, Pakistan, Mauritius, Jordan, Bahrain, and Azerbaijan. The user must also be of the age of consent to enter into a binding agreement in their country (or older), they must legally be an adult, and they must have a Viber account. Employees of Viber and Rakuten Group, as well as their family members or anyone else involved in the organization or administration of the Competition, are prohibited from taking part. Employees of the Organizer, Black Mustand One LTD, and other affiliated companies, as well as their family members or anyone else involved in the organization or administration of the Competition are prohibited from taking part.

Duration and Validity of the Promotion

The Promotion starts on 1 June 2021 and ends on 1 June 2024.

If a Participant (as defined hereunder) attempts to obtain more than the permitted number of Entries (as defined hereunder) by using multiple Viber accounts, email addresses, or ID numbers, or by any other means, all Entries by said Participant will be considered invalid. The Organizer reserves the right to verify the eligibility of all Participants. Illegitimate and/or incomplete Entries, as well as Entries submitted by Participants who do not meet the eligibility requirements, are invalid.

The terms and conditions set out in the “Terms”, which include the Privacy Policy and Cookie Policy (available on the 1xBet website under “Terms and Conditions”), apply to the user’s participation in the Competition. This Privacy Policy fully complies with the requirements and principles of the General Data Protection Regulation (GDPR). By taking part in the Competition, the user consents to their personal data being processed (within the limits of and for the purposes set out in the Privacy Policy) in accordance with the Terms.

The terms and conditions set out in the Public Account, Public Chat, Bot, Community, and Viber Admin Panel (VAP) Terms and Guidelines (available at https://www.viber.com/terms/chat-public-accounts-terms-guidelines/ and periodically amended), as well as the Viber Privacy Policy (available at https://www.viber.com/terms/viber-privacy-policy/ and periodically amended) also apply to the user’s use of the BOT.

1 Participation in the Competition

1.1 General Provisions

1.1.1 Participation in the Competition is free and does not require any purchases to be made or fees to be paid.

1.1.2 For the duration of the Competition, Bot subscribers of the appropriate age with eligible dial codes will have the opportunity to predict results in both teams and individual sports through the Chat Leaderboard feature (hereinafter the “Matches”) and also to take part in the global Competition. Once they have joined the activity of Black Mustand One LTD Viber through one of the various available channels (hereinafter the "Activity"), they will be redirected to the Black Mustand One LTD chatbot (hereinafter the “Bot”), where they can choose whether they want to predict results and share them with friends only, or take part in the global Competition and win prizes. In order to participate in the Competition, the user must confirm their age, select ‘Yes, I agree’, agree to these Terms, and play in accordance with the rules set out hereunder. Selecting ‘Yes, I agree’ is considered to be an "Application" and tantamount to participation in the Competition, and is subject to the Terms of this Agreement. If the user selects ‘Yes, I agree’, they are considered to be a "Participant" in the Competition. If they select ‘No, I don't want to win prizes', they will not be considered a Participant in the Competition, and will therefore not appear on the Competition leaderboards (as defined hereunder) and will not be entitled to win any prizes. 

1.1.4 Throughout the user’s participation in the Competition, their Viber username and profile picture, together with the number of points they have earned, will be displayed on the global leaderboards, which will be visible to all Participants in the Competition (hereinafter the “Competition Leaderboard”). If a user’s Viber username is a phone number or the Viber system suspects that it is one, their username will appear as "Unknown" on the Leaderboard.
By deciding to take part in the Competition, the user gives the Organizer and Viber the right to display their username and profile picture, together with the number of points they have earned, on the Competition Leaderboard. Users should not take part in the Competition if they do not want their Viber username and/or profile picture to appear on the Competition Leaderboard.

1.1.5 Regardless of whether the user decides to only take part in an event and not the Competition or to take part in the Competition as well, they can predict the results of matches in private Black Mustand One LTD Viber group chats and keep track of the number of points they have earned (however, if the user is not participating in the Competition, they will not appear on the Competition Leaderboard and will not be able to win prizes). When the user shares their predictions, they can easily create a group leaderboard using the "Chat Extension" feature. Other Viber users who want to join and appear on the group leaderboard must share their predictions in the same group.

1.1.6 Viber users can only make one prediction per match and this prediction is applied to all the leaderboards on which that user appears (for example, if they have one leaderboard with their friends and another with colleagues, their most recent prediction will be applied to both leaderboards).

1.2 How to compete

1.2.1 The Bot accepts predictions on the outcome of a match/game and ranks users who make predictions.
 

For Football:

Before making a prediction, the user must select a country/league (e.g. Russia, England, Italy, Spain, or Germany) or a tournament (e.g. UCL or UEL). The list for each option shows the number of events currently available (upcoming matches).

Before making a prediction, the user must select a tournament, either national or international. The list for each option shows the number of events currently available (upcoming matches).

Note:

To increase interest and engagement in the Competition, the Organizer has the right to add the most interesting events under the general terms and conditions of the Competition.

Points and predictions

For football and ice hockey, predictions are accepted on three markets: 1 To Win, Draw, or 2 To Win.

For esports and MMA, predictions are accepted on two markets: 1 To Win or 2 To Win.

If an event is canceled or rescheduled, predictions on it are considered valid, but the user does not receive points that affect their ranking.

There may come a time when the user needs to make several predictions, but there are no events available. In this case, the user should wait until the required number of events become available.

Each user can only make three predictions per day on the outcome of events available in the Bot list and these must be made before each event begins. Users can make full use of their available predictions by making three predictions at once or over the course of a day, or not make any at all. Unused predictions are not carried over to the next day.

Users cannot make multiple predictions on the same event.

Points are awarded after the results of the event have been determined. In some cases, there may be a delay in the announcement of the results.

Basic mechanics

All new users begin with 100 points and all users begin each stage with 100 points.

Each available market has odds assigned to it which are added to (for a correct prediction) or subtracted from (for an incorrect prediction) the user's total.
 

E.g.:

A user selects the match "Team 1 versus Team 2", the Bot offers odds of 1.37 on W1, 2.55 on a Draw, and 1.94 on W2. The user predicts that Team 1 will win. If, according to the results of the game, this prediction is correct, 1.37 is added to their total; however, if the prediction is incorrect, 1.37 is subtracted from their total.

The user may receive an additional point if they make three consecutive correct predictions. The predictions can be made on the same day or over several days, as long as they make a chain of three correct predictions.

Users are rewarded for regular play. If, over the course of a calendar month, a user regularly interacts with the Bot and makes at least one prediction a day, they will receive an additional 10 points when the results of that stage are determined.

To take part in a stage, each user must make at least 15 predictions over the course of the corresponding calendar month.

Rankings:
Participants can view their position in the global rankings.

Definitions:
Stage – a calendar month
Season – each three-month period, starting on 1 June 2021

Participants are ranked according to their points total, which is calculated by adding (for a correct prediction) or subtracting (for an incorrect prediction) the odds of the events on which they have made a prediction to/from their starting total.
In order to be included in the results for a season, each Participant must make at least 15 predictions in each stage. If this condition is not fulfilled at a given stage, it will not be counted in the overall results for the season.

A Participant's ranking depends on the results of their predictions and their daily activity level. All new users start with 100 points and all users begin each stage with 100 points.

1.2.2 At the end of the Competition, the Participant who has earned the most points in a stage/season is declared the winner of the Competition (hereinafter the "Winner") and is eligible to win the grand prize (as defined hereunder). If several Participants have the same number of points, the Participant who made the most predictions ranks higher (this rule applies to stages as well as seasons). If several Participants have the same number of points and predictions, the Participant who reached the higher number first ranks higher.

1.2.3 The Organizer may add more actions and options at its discretion to allow Participants to earn more points in the Competition.

1.2.4 The Organizer and Viber bear no responsibility for Match predictions that are not received in time or are not received for any other reason, including as a result of a technical error or malfunction.

1.2.5 The results of a stage are announced the day after it ends and are based on the results of events that took place during that month. All other prediction results established later than this are included in the results for the next stage.

1.2.6 The results of a season are calculated by adding together the results for each stage.

2. Prizes

2.1 The top 50 users in the rankings of a stage receive a free bet:
1st to 5th place receive a free bet worth $10 on the 1xBet website *
6th to 20th place receive a free bet worth $5 on the 1xBet website *
21st to 50th place receive a free bet worth $3 on the 1xBet website *

2.2 The Winner of a season receives the latest smartphone from a famous brand (hereinafter the "Grand Prize")

2.3 Additional prizes (hereinafter "Competition Prizes") are awarded to runners up:
2nd place receives a watch from a famous brand
3rd place receives headphones from a famous brand
4th to 20th place receive a free bet worth $15 on the 1xBet website *
21th to 50th place receive a free bet worth $10 on the 1xBet website *

* Free bets can only be used once and must be used in full on accumulators consisting of at least three selection. Each selection must have odds of 1.40 or higher. Free bets are valid for 15 days.

If a Prize cannot be delivered to the Winner's region, the Organizer may decide at its discretion to pay the Winner a sum equal to the price of the Prize by any means available, as agreed with the Winner. This applies to all the aforementioned Prizes with the exception of Prizes in the form of free bets. The Grand Prize and Competition Prizes are hereinafter referred to as "Prizes".

Note: Apple is not a participant or sponsor of this promotion.

2.4 Competition Winners are contacted (notified) by the Bot directly via private message within 14 (fourteen) days of the end of the promotion. Competition Winners must respond via private message to the Bot within 72 (seventy-two) hours of receiving this notification and provide their full name, email address, postal address, and contact details. The Organizer bears no responsibility in the event that the Competition Winner(s) provide(s) incorrect information.

2.5 The Organizer reserves the right to verify the Competition Winner's compliance. The Organizer reserves the right to send the Competition Winner(s) a written statement as to their compliance with their obligations and commitments together with any other documents (jointly referred to as the "Competition Documents") by registered mail and/or email. If the Competition Winners do not provide their contact details within five (5) days of the date on which they received the Competition Documents or if the information provided is inaccurate, the Prize will not be awarded. The Organizer and Viber bear no responsibility if the Winner is for any reason unable to respond in time upon being notified or is for any reason unable to return the Competition Documents.
The Organizer reserves the right to verify the eligibility of any Participant. If any questions should arise regarding the identity of the individual who submitted an Application, the Application is deemed to have been submitted by the individual in whose name the Viber account was registered when the Application was submitted, but only if this person meets all other eligibility criteria.

2.6 Competition Winners will be officially announced through the Bot within 14 days of the end of the promotion.

2.7 Winners are solely responsible for any federal, state, or local taxes and duties, along with any charges associated with the delivery and/or use of the Prize which are not included in the Prize description. Winners acknowledge and agree that complying with tax laws is solely their responsibility, and the Organizer bears no responsibility in the event that any applicable tax law is not complied with.

2.8 Unless it is prohibited by law, by participating in the Competition and accepting a Prize, Winners give the Organizer the irrevocable, sublicensable and absolute right and permission to use, publish, distribute, and display the Winner's name, photograph, likeness, statement, personal details, voice, address, information about the Prize, any quotations relating to the Winner, and any other identifying characteristics (regardless of whether they have been changed, redacted, or used individually or with other materials at the Organizer's discretion) which are currently known or will be processed in the future, for any purpose including (but not limited to) for advertising or commercial purposes, or for publishing worldwide and on all forms of mass media, in perpetuity, without the need for any further permission, notification, or opportunity to review, approve or be compensated in any way. In addition, all Winners absolve the Organizer of any responsibility related to them. Nothing contained within these Terms obliges the Organizer to exercise any of the rights granted in this document, and Winners waive any right to verify or approve any instance of these rights being exercised.

2.9 Names, video recordings, and any other likenesses of Grand Prize Winners may be published by the Organizer via mass media and other social networks, including, but not limited to, Facebook, including for, but not limited to, commercial purposes. Without being limited by the previous paragraph, by taking part in the Competition and/or claiming a Prize, all Participants hereby unreservedly consent to the publication of information as described in the previous sentence to the fullest extent permitted by law.

2.10 The Organizer reserves the right to verify the eligibility of all Participants. If any questions should arise regarding the identity of the individual who submitted an Application, the Application is deemed to have been submitted by the individual in whose name the Viber account was registered when the application was submitted, but only if this individual meets all other eligibility criteria, otherwise the application may be considered void and any potential winnings withdrawn at the Organizer's discretion.

2.11 The Organizer reserves the right to change any of the Prizes, as well as to add and/or remove Prizes at its discretion.

2.12 No part of any of the Prizes can be transferred, purchased for cash, or replaced with anything, except by the Organizer (at its discretion), which reserves the right to change any part of a Prize for a Prize of equal or greater value for any reason, including, inter alia, if it is not possible to acquire a particular Prize. Any charges not specified as being included in the Prize are the sole responsibility of the Winner. Prizes and all their constituents are provided subject to availability. Prizes are awarded "as they are" and WITHOUT ANY GUARANTEES, whether explicit or implied (including, but not limited to, any implied guarantees of merchantability or fitness for a particular use). Winners accept, use, and/or engage with a Prize at their own risk, and the Respondent Parties (as defined hereunder) bear no responsibility for any damages, including extraordinary or consequential damages, incurred as a result of or in relation to the use and/or improper use of the Prize.

3. EXEMPTION FROM LIABILITY 

PRIZE WINNERS AND PARTICIPANTS ABSOLVE THE ORGANIZER AND ANY AND ALL ASSOCIATED MANAGERS, MEMBERS, DIRECTORS, OFFICIALS, OPERATORS, EMPLOYEES, PARENT AND SISTER COMPANIES, AFFILIATES, AGENTS, REPRESENTATIVES, AND DEPENDANTS (COLLECTIVELY REFERRED TO AS "RESPONDENT PARTIES") FROM ANY LIABILITY, AND AGREE TO PROTECT THE RESPONDENT PARTIES FROM ANY CHARGES, HARM, OR CAUSE FOR LEGAL ACTION (REGARDLESS OF HOW THEY ARE NAMED OR DESCRIBED), IN RELATION TO ANY HARM, INJURY, OR DAMAGES CAUSED TO ANY INDIVIDUAL (INCLUDING DEATH), OR PROPERTY OF ANY KIND LEADING TO THE FULL OR PARTIAL DAMAGE, DIRECTLY OR INDIRECTLY AS A RESULT OF THE ACCEPTANCE, POSSESSION, IMPROPER USE OR USE OF A PRIZE OR ANY PART THEREOF, OR AS A RESULT OF PARTICIPATION IN ANY ACTIVITY RELATED TO THE PROMOTION OF OR PARTICIPATION IN THE COMPETITION.

 
4. Limitation on Liability

The Organizer bears no responsibility for late, compromised, incorrectly sent, incomplete, incomprehensible, undelivered, deleted and/or lost Entries as a result of system errors or malfunctions, or incorrect transmission and/or Entries or Match Predictions not received as a result of any hardware, software or technical malfunctions of any kind, lost or inaccessible network connections, or faulty, incomplete or distorted computer, internet, or telephone transmissions, or any problems or technical faults with any telephone network or line, online computer systems, servers or providers, or computer equipment, or for Entries or Match Predictions not received by the Organizer via Viber as a result of technical issues or traffic overloads on computer networks or any combination of the above, including any harm or damage to the computer of the Participant or of any other individual taking part in the promotional event or downloading any materials for the Competition, or other faults in telecommunications that may limit the Participant's ability to take part in the Competition. The Organizer may prohibit a Participant from taking part in the Competition or from winning a Prize if, at its sole discretion, it determines that said Participant is attempting to undermine the legitimacy of the Competition through deception, hacking, fraud, or any other illegitimate activity (including the use of automatic rapid entry software), if said Participant attempts to belittle, insult, threaten, or harass any other Participants, the Organizer, or representatives of Viber and/or if the Viber username or profile picture displayed on the Competition Leaderboards is illegal, harmful, threatening, insulting, vulgar, obscene, violates the privacy of another person, or expresses racial or ethnic hatred or intolerance. If, for any reason, the Competition does not go according to plan, including, inter alia, due to a computer virus, errors, unauthorized interference, fraud, or any other reasons beyond Viber's reasonable control that damage or affect the administration, security, impartiality, integrity, or proper implementation of the promotion, the Organizer reserves the right to cancel, end, alter, or suspend the Competition at its own discretion.

5. Additional Limitations on Liability

5.1 To the fullest extent permitted by the law, the Organizer, Viber, and the rest of Rakuten Group bear no responsibility under any circumstances for any harm or damages of any kind, including direct, consequential, accidental or punitive damages relating to the Competition, including from any accessing or use of Viber, or from the downloading or printing of materials from Viber. Everything on Viber is provided "as is" without any explicit or implied guarantees, including implied guarantees of merchantability, fitness for a particular purpose, or non-violation. Limitations on or exclusions of liability for incidental or consequential damage, or exclusions of implied guarantees may be prohibited in certain jurisdictions. Some of the aforementioned limitations and exclusions may therefore not apply. Prizewinners consent to Prizes being provided "as they are", without any guarantees or assurances, whether explicit or implied, de facto or de jure, regardless of whether they are currently known or will apply in future, in relation to the use or exploitation of a Prize, including, but not limited to, its quality, tradability or fitness for a particular purpose. In addition, no responsibility is accepted for any additional charges, oversights, delays, or route changes as a result of any action on the part of any government or agency. Viber in no way participates in the organization of the Competition and merely serves as a platform for the Organizer. Viber therefore bears no responsibility for any issues relating to the Competition.

5.2 To the fullest extent permitted by law, the Organizer, Viber and the rest of Rakuten Group bear no responsibility under any circumstances for any changes to and/or inconsistencies between the odds given on the Bot for information purposes at the moment the User places a bet and the final odds on the Organizer's website.

6. Disputes

Unless it is prohibited, the Participant agrees that: (1) any disputes, complaints, and grounds for legal action that arise as a result of or relating to the Competition or any other awarded Prize must be resolved on an individual basis, without recourse to any kind of group action, and exclusively at the appropriate court in London, United Kingdom; (2) the Competition and any dispute arising therefrom or in relation thereto (whether in relation to a breach of contract, misconduct, or any other issue) are subject to the laws of England and Wales, excluding conflict-of-laws rules or a choice of legal principles or rules that may result in the application of any other laws.

7. General

7.1 The Organizer reserves the right to alter the Activity and/or the Competition or any part thereof and the Terms (including, inter alia, changes to the Duration, Prizes, Competition structure, validity period of Bet Slips, etc.), and may end the Activity and Competition at any time without prior notification, at the Organizer's sole discretion and without any liability on its part. The Organizer's decisions on all issues related to the Activity and/or the Competition are final.

7.2 Without deviating from any of the provisions of these Terms, the Participant specifically recognizes, is aware of, and consents to the fact that their Viber username and profile picture may be published by the Organizer, including to the general public via mass media and other social networks, including, but not limited to, Facebook, for the purposes of promoting the Competition.

7.3 By sending an Application or participating in the Competition by any other means, the User consents to receiving marketing and advertising materials from the Organizer, Viber, and the rest of Rakuten Group. In addition, by submitting an Application to the Competition, the User consents to their information being sent to the Organizer, Viber, and the rest of Rakuten Group in accordance with their Terms of Use and Privacy Policy.

7.4 The Organizer bears no responsibility for any delay in the delivery of a Prize or for a Prize not being delivered if this is caused by an event beyond its reasonable control (hereinafter "Force Majeure"). "Force Majeure" denotes: war, invasion, acts of a foreign adversary, acts of terrorism, acts of war, civil war, riots, armed uprising, blockade or embargo; formal or informal strikes, wait-and-see policy; flooding, drought, hurricane, fire, explosion, ionizing radiation, radioactive contamination, earthquake, lightning, volcano eruption, or any direct consequence of a similar occurrence; any other event or cause beyond the reasonable control of the Organizer.
